What Are DSCSA Saleable Returns?

A "saleable return" is a drug product that a pharmacy, clinic, or other downstream trading partner sends back to a wholesale distributor with the intention that the distributor will resell or redistribute the product. This is different from a return for destruction or disposal.

The Verification Requirement for Returns

Before a wholesale distributor can accept a returned product back into its saleable inventory, DSCSA requires that the distributor verify the product's product identifier. Specifically, the distributor must:

  1. Verify that the product identifier (NDC + serial number + lot + expiration) is authentic
  2. Confirm the product was not part of a recall or withdrawal
  3. Confirm the product is not suspect or illegitimate based on the verification result

This verification must occur before the product is returned to saleable inventory. Distributors cannot simply trust that a pharmacy would only return authentic product.

How Verification Works for Returns

The verification process for saleable returns typically involves:

  • Scanning the 2D barcode on the returned package to capture the product identifier
  • Querying a Verification Router Service (VRS) to confirm authenticity with the original manufacturer
  • Recording the verification result and retaining it for 6 years

If verification fails (i.e., the manufacturer cannot confirm the product identifier is authentic), the product must be quarantined and investigated as suspect product. It cannot be returned to saleable inventory.

Pharmacies and Returned-to-Stock

Pharmacies have a parallel obligation: when product is returned from a patient or caregiver and the pharmacy intends to return it to stock for redispensing, the pharmacy must verify the product identifier and confirm the product has not been recalled.

In practice, most state boards of pharmacy prohibit the return of dispensed product to stock for redispensing. However, product returned directly from a long-term care facility or clinic (in the original, sealed manufacturer packaging) may be eligible for return to stock, subject to state law and the pharmacy's policies.

Quarantine and Investigation Procedures

When a wholesale distributor or pharmacy quarantines returned product pending investigation, it must:

  1. Physically separate the quarantined product from dispensable inventory
  2. Label the quarantined product clearly
  3. Investigate within a reasonable timeframe
  4. Determine whether the product is authentic, suspect, or illegitimate
  5. If illegitimate: notify FDA within 24 hours and notify all known trading partners that received the same lot
