DSCSA Requirements for Wholesale Distributors

Wholesale drug distributors occupy a critical position in the pharmaceutical supply chain and face some of the most stringent DSCSA compliance obligations. As the intermediary between manufacturers and pharmacies, distributors must verify product from above (manufacturers and other distributors) and provide compliant T2 documentation (TI + TS) below (to pharmacies and clinics).

Wholesale distributors became fully subject to all DSCSA enhanced drug distribution security requirements on August 27, 2025, when their phased exemption from the November 27, 2024 enforcement period expired.

Authorized Trading Partner (ATP) Status

DSCSA requires that wholesale distributors only purchase from and sell to "Authorized Trading Partners." An ATP is a trading partner that:

• Holds a valid state wholesale distributor license in every state where it operates
• Is registered with the FDA under the Drug Supply Chain Security Act
• Has a valid DEA registration (for Schedule II-V products)

Distributors must verify ATP status before conducting any transaction. This includes verifying the license of both the seller above them and the buyer below them.

Premier Pharma maintains current licensure in all states where we operate and is registered as an ATP with the FDA. We verify the licensure of every customer before shipping product.

Verification Obligations

Wholesale distributors must verify product identifiers at the unit level when:

• Receiving returned product from downstream trading partners
• Conducting random verification as part of their quality program
• Responding to a request from a trading partner or the FDA
• Investigating a suspect product alert

Distributors must also participate in the Verification Router Service (VRS) ecosystem, meaning their systems must be capable of sending and receiving verification requests.

Suspect and Illegitimate Product Reporting

When a wholesale distributor determines that product in its possession or control is suspect, it must:

1. Quarantine the product immediately
2. Investigate to determine whether the product is illegitimate
3. Notify the FDA within 24 hours of determining the product is illegitimate
4. Notify all known trading partners that received the same product
5. Cooperate with FDA investigation and disposition decisions

Failure to report illegitimate product is itself a DSCSA violation.

Record Retention

Wholesale distributors must retain all DSCSA records for 6 years, including:

• T2 documents (TI + TS) for every transaction (inbound and outbound)
• Verification records
• Suspect and illegitimate product investigations and dispositions
• Recall and withdrawal records

NABP VAWD Accreditation

Premier Pharma holds NABP Verified-Accredited Wholesale Distributors (VAWD) accreditation, which requires annual audits of DSCSA compliance practices, facility standards, and security controls. VAWD accreditation is widely recognized by state boards of pharmacy as evidence of responsible wholesale distribution practices.
